Terms and conditions
1. Purpose and Scope of the Service
This document establishes the terms and conditions that govern the contracting of express freight and logistics transport services offered by Bahn Logística (hereinafter, "The Carrier") in the main Buenos Aires-Rosario corridor and its complementary services.
The use of any of our services implies full and unreserved acceptance of these conditions.
2. Rates and Quotations
Quotation Validity: Every quotation issued by The Carrier has a specific validity (e.g., 5 business days) and is based on the weight, volume, type of merchandise and destination information provided by the customer.
Modifications: Any variation in the dimensions, weight or nature of the load once the quote has been accepted may result in an adjustment to the final price.
Billing and Payment: Services will be billed according to the agreed rate. Payment must be made under the conditions stipulated in the quote (e.g., prepayment, 50% upon contracting and 50% upon delivery, or 30 days for corporate clients).
3. Responsibility for Cargo and Insurance
Declaration of Value: The customer is responsible for declaring the actual value of the goods. This declaration will serve as the basis for contracting transport insurance.
Packaging and Conditioning: It is the customer's sole responsibility to ensure that the cargo is properly packaged, conditioned, and labeled to withstand normal handling during ground transportation. The Carrier reserves the right to refuse any cargo deemed improperly packaged.
Insurance Coverage: The merchandise will be covered by the minimum legal insurance. The client may request additional coverage (Comprehensive Insurance) on the total declared value, the cost of which will be included in the quote.
Limits of Liability: The Carrier's liability is limited exclusively to what is stipulated in the contracted insurance policy and in accordance with current legislation.
4. Express Service and Delivery Times
Express Commitment: The Express Transport service aims for maximum speed in base-to-base delivery (Rosario-BA / BA-Rosario).
Delays: The Carrier is not responsible for delays or failure to meet delivery deadlines caused by force majeure, acts of God, accidents on the road not attributable to our fleet, or provisions of public authorities.
5. Prohibited Goods
The Carrier reserves the right to refuse to transport goods that, including but not limited to, are considered dangerous, illegal, perishable without adequate refrigeration, or whose transport is prohibited by Argentine law.
6. Jurisdiction
For any dispute that may arise in relation to the provision of services, the parties will submit to the jurisdiction of the courts of the city of [City where the main base operates, e.g., Rosario or Buenos Aires], waiving any other jurisdiction that may correspond to them.
